Saudi Arabia’s Ministry of Tourism has approved a new bylaw allowing Saudi citizens to rent out their homes to tourists, which paves the path for rental accommodation facilities like Airbnb, HomeAway, and Vrbo to start operating in the country.

The bylaw would allow Saudi citizens to apply for permission to rent out their homes, with a maximum of three permits being awarded to one individual per property. Additionally, a private tourist hospitality facility, such as a townhouse, apartment, or villa, must be located on land that has been set aside for either residential or agricultural use.

The owner is also required to submit an electronic lease agreement that attests to their ownership or usage of the property in question. Along with their application, the owner must include any necessary legal documentation pertaining to the property.

The ministry has provided a list of legislation to make sure that tourists’ rights are protected when residing in rental homes. The owner is responsible for making sure that the online images of the property are accurate, while all rates for services at the property, including any applicable statutory fees and taxes, must be prominently displayed in both Arabic and English.

Owners can never access the property regardless of whether the renting party is inside or not, without first obtaining permission. This section is only exempt in emergency situations when the owner is accompanied by appropriate authorities. Meaning that after checking in, a tourist cannot be made to leave the residential unit without the presence of the appropriate authorities.

Finally, a visitor must present a valid ID to establish their identity before being admitted to the facility.
